Referring to the report, No 45/2009, the Board POZBUD T & R SA ("Company") announces that on 2 March 2010, the Financial Supervision Commission approved the prospectus POZBUD T & R SA prepared in connection with public offering of 5,000,000 Shares of Series E, and also in relation to the application for admission to trading on a regulated market for 5,000,000 Shares of Series E and the Rights of the 5,000,000 Shares Series E. (offering is BZ WBK Brokerage House SA).

Prospectus containing detailed information concerning the Company and the public offering, including deadlines for offers, will be published on 4 March 2010, the Company's website and offers: www.pozbud.pl and www.dmbzwbk.pl

Series E Shares will be offered with the exception of pre-emptive rights to existing shareholders.

However, in view of the projected allocation of preferences in the Series E Shares to the shareholders of the Company, the Board announces that in connection with the planned publication of a prospectus on 4 March 2010, Day Uprawnienia for preferential allotment to the shareholders (in a ratio of 1 (one) Series Akcja E for 4 (four) existing shares of the Issuer) will fall on 11 March 2010 (ie at the end of the seventh day following publication of a prospectus.)

In view of the foregoing, the Board points out that investors who intend to participate in a public offering of Series E Shares of the Company and intend to take advantage of the preferences referred to above, should take into account that the last day nabycia on the Stock Exchange of existing shares of the Company giving the right to preferential allotment of shares of Series E is

March 8, 2010, the sale thus the existing shares of the Company on that date deprives the investor of such a right.
