Board of POZBUD T & R SA announces that on 06.04.2009 years, he learns of the agreement with the Company Engineering Works POL-AQUA SA, established in Piaseczno.

The subject of the agreement is a comprehensive supply and installation of wooden window frames, door frames and wooden facades in the job "Construction of a residential building at ul. Górskiego 6 in Warsaw."

The value of your contract is PLN 2,500,000.00 net.

Deadline for implementation of the agreement is between -15.05.2009 until the -30.07.2009

The agreement contains provisions relating to contractual penalties in accordance with which to pay the penalty by:

• in the event of failure to meet the deadline for completion of work outlined in the contract - of 0.5% of the total remuneration referred to the contract for each day of delay. The maximum amount of fines is 15% of contract value.
• in the event of failure to meet deadlines specified in the contract indirect - of 0.5% of total net pay particular contract for each day of delay. The maximum amount of fines is 15% of contract value.
• in the event of withdrawal by the Employer for reasons attributable to the Contractor, the Purchaser shall be entitled to claim liquidated damages - amounting to 10% of salary,
• in case of delay in commencement or completion date removal or repair of defects and repair faults within the warranty period or warranty or refuse to remove them or repair, the Purchaser shall be entitled to claim liquidated damages - amounting to 0.5% of the window without flaws, which is to be repaired or replaced, for each day of delay.
• in the event of a breach of duties and safety rules, safety and occupational health and of the work and fire regulations, rules on the protection of nature and the environment and the obligation to maintain order on the construction of Purchaser shall be entitled to claim liquidated damages in the amount - the amount of 1500.00 zł (say a thousand five hundred) for each infringement confirmed by the investor's supervision inspector.

Contractor will be entitled to claim liquidated damages of 0.5% of the total net salary for each day of delay in their accession to the final acceptance by the Purchaser.

Management of the Company shall provide information about this agreement, due to the fact that it is the implementation of a cooperation agreement referred to was in the current report No. 12/2008 of 17 June 2008
