Legal basis: Article 56, paragraph. 1 point 2 of the Act on Public Offering - current and periodic information
Board of POZBUD T & R SA announces that on 28.04.2009, he signed a contract with Hydrobudowa 9 Enterprise Engineering - Construction Joint Stock Company established in Wysogotowo.
The object of the contract is complex execution, delivery and installation of joinery aluminum, steel and cladding facade by POZBUD T & R SA in the investment business under the name "Building office and service building with underground parking on the street Goreckie 1 in Poznan.
The value of your contract is PLN 16,100,000.00 net.
Implementing the agreement will be followed from the II / III quarter of 2009 (14 days after written notice by the Employer) to 31.12.2009 (30 weeks of written notification by the Purchaser).
The agreement contains provisions relating to contractual penalties, according to which the contractor will pay the penalty:
a) in case of withdrawal for reasons attributable to the contractor - 10% of the gross contractual salary;
b) for each day of delay in the implementation phase of the works in relation to the deadline specified in the schedule - 0.1% of gross contractual salary. The same applies to the intermediate time,
c) the inappropriate timing of the removal of defects, to remove the contractor is obliged under the guarantee, - 0.1% of gross contractual salary for each day of delay in relation to the date on which would be the removal of defects,
Contractor will be entitled to claim liquidated damages:
a) in case of withdrawal by the fault of the Employer - 10% of the gross contractual salary;
Maximum height of any contractual penalties which can be paid either party shall be 10% of the gross contractual salary.
They also reserved the right to additional compensation in excess of contractual penalties to the amount actually legitimate losses.
The agreement was regarded as significant because its value exceeds 10% of the equity of the Issuer.
